It is a highly anticipated decision which will clarify how far the recognition of the parentage of a child born from surrogacy abroad can go, while the use of a surrogate mother is prohibited in France. Friday July 3, the Court of Cassation will deliver a judgment which could mark a turning point and revive the debate launched by the Renaissance presidential candidate, Gabriel Attal. The former Prime Minister has in fact announced that he wants to open a discussion on the legalization of an “ethical surrogacy”, that is to say without commercial transaction, to “break a taboo”. “The reality of these families exists, whether we like it or not” and “we must debate it,” he writes in his book En Homme libre (L’Observatoire).
