Three famous Spanish influencers were fined in June for not having respected the rules on advertising in their content or those on the protection of minors, Spanish authorities said on Thursday.
“The files concern the absence of clear identification of commercial communications, the absence of adequate measures to protect minors and the dissemination of advertising of medicines without respecting the specific applicable requirements,” said the Spanish National Markets and Competition Commission (CNMC) in a press release.
Ibai (Ibai Llanos), a YouTuber and star streamer in Spain with more than 17 million subscribers on the Twitch platform, was fined 710 euros for promoting a brand of drink during the broadcast of videos on X of a sporting event, without specifying that it was an advertisement.
“The user must be able to know, in a simple way, when they are viewing a commercial communication” which must be distinguished from editorial content, underlined the CNMC.
Famous influencer and Youtuber, Jordi Wild will have to pay him 1,543 euros for not having displayed the necessary warnings for sensitive content for minors, when broadcasting extreme combat sports videos on his YouTube channel to more than 12 million subscribers.
“The lack of classification” of content sensitive to minors “may limit the effectiveness of parental control systems,” said the Spanish regulator.
Finally, influencer Nachter — who has six million subscribers on YouTube — was fined 1,779 euros for promoting a flu medication on his platforms “without respecting the requirements applicable to the advertising of medications”, in particular “the invitation to read the instructions or to consult the pharmacist in case of doubt”.
The objective of these regulations is to “protect consumers, in particular minors, and to guarantee that the public can clearly distinguish between editorial content, entertainment and advertising,” insisted the CNMC.
