The Assize Court of the Moselle sentenced Maroof Easakhail on Friday to 25 years in criminal imprisonment for The murder of his pregnant companionAnita Gashi, in the volunteer fire of their apartment in June 2022. The Court found him guilty of murder on spouse and held the intention of death, which the 33 -year -old Afghan had tried to deny during his trial.
The penalty, below the requisitions of the Advocate General who had requested 30 years’ imprisonment, is accompanied by a period of security of 12 and a half years, as well as a ban on holding a weapon for 15 years.
A five -month pregnant, Anita Gashi, seriously burned, lost the fetus she wore the day after the drama. Burned more than 90 % in the third degree, she died from her injuries a month after the facts. She could never be heard.
“Inconsistencies”
Maroof Easakhail changed version several times during the procedure. During the trial, he for the first time he admitted to having set fire to their accommodation, claiming that he had orchestrated with his partner insurance fraud but never intended to kill her.
“We have not at all believed in your version which is filled with contradictions and inconsistencies, it is a montage, a creation, to adapt to the advanced elements against you,” said the president of the court, Nicolas Faltot.
“A pure invention,” also estimated the Advocate General, Cédric Lausmone, who noted that in the social housing occupied by the couple, there was “no object of great value in the apartment which would have given rise to staggering compensation”. In addition, the investigators noticed that Maroof Easakhail had no trace of burns or soot, when he claimed to have done everything to save his partner.
“He killed part of his son”
For Cédric Lausmone, the mobile of crime does not reside “in a context of domestic violence – which are not really highlighted in the investigation” – or in “Anita Gashi’s will to leave him: she wanted a second child of him”.
The Advocate General put forward a “cynical hypothesis” to explain his act, that of an accused who “wanted to get rid of his wife who was no longer used for nothing, after having obtained his son and his residence permit! »»
“What is unbearable in its sneaky version is that he includes Anita,” said Me Samira Boudiba in his argument, the victim’s family council, who made the bus trip from Serbia to “come and attend the trial of their daughter and sister. »»
“By killing Anita Gashi, he killed part of his son,” said Me Zakia ALI Slimane, a lawyer representing the rights of the couple’s first child, a seven -year -old boy, “full of anger and sadness, who lost his mother, his little brother and whose future is uncertain. »»
