The Federal Consumer Prosecutor’s Office (Profeco) announced that it will file a formal complaint with the Attorney General’s Office (FGR) against a service station located in the city of Durango, Durango, due to the removal of warning stamps and signs related to the high price of fuel.
According to the institution, the complaint will be based on the provisions of article 187 of the Federal Penal Code. Furthermore, he clarified that will carry out a new inspection to reinstall the seals, a measure that is independent of the administrative sanctions derived from the withdrawal of these warnings.

Among the actions implemented by Profeco, the placement of warning seals was included next to a tarp with the legend: “Don’t load here, they blow the fence with the prices,” directed to three service stations. One of these gas stations is located at Domingo Arrieta Boulevard number 222, in the city of Durango.
According to the agency, these actions arose as a result of inspection visits carried out by Profeco personnel in compliance with articles 8 and 13 of the Federal Consumer Protection Law. During these reviews, station managers were asked for the necessary documentation to justify the cost at which they sold the fuel.
Currently, Profeco is evaluating the information provided by the legal representatives of the service stations involved, with the aim of determine whether the increase in prices is duly justified. However, the agency noted that the removal of the seals and warnings constitutes a crime classified in the Federal Penal Code, which has motivated the complaint that will be presented to the FGR.
The head of Profeco, Iván Escalante Ruiz, explained that in the case of the three gas stations involved, located in Monterrey (Nuevo León), Durango (Durango) and León (Guanajuato), The complete verification procedure will be carried out. In the event that the irregularities that gave rise to the precautionary measures are corrected during this process, seals and warning banners may be removed, in accordance with the provisions of the penultimate paragraph of article 25 Bis of the Federal Consumer Protection Law.
