This Tuesday it was announced through a letter addressed to the President of the Board of Directors of the Chamber of Senators, Gerardo Fernández Noroña, the resignation of Minister Alfredo Gutiérrez Ortiz Mena from the Supreme Court of Justice of the Nation (SCJN).
“Today I face a constitutional reform that shortens the mandate for which I was invested. I am presented with two options: submit to a popular election process or present my resignation. I do not consider myself a suitable candidate for a position that depends on popular support,” Ortiz Mena expressed in the letter.

The minister pointed out that the resignation “does not imply a tacit acceptance of the constitutionality of the reform” and assured that “out of respect for the Constitution that I swore to defend, my resignation will take effect on August 31, 2025”, the day until he will continue with his responsibilities within the highest court.
“I resign, not as one who abandons an unfinished task, but as one who understands that public positions are temporary loans, conferred to be performed with decorum while the assignment lasts. The only luxury I allow myself when leaving this position is to do so with the serenity of having been faithful to the constitutional principles that guide this work. In the end, the true triumph is not clinging to one’s position, but knowing when to leave it gracefully, aware that no one is indispensable, only free,” Gutiérrez Ortiz Mena said in the document.
