The Morena majority withdrew the modifications to articles 1 and 105 of the Constitution from the ruling, in the face of criticism from the opposition regarding human rights violations. The opinion was submitted to the Board of Directors of the Senate and it was ordered to be published in the Parliamentary Gazette.
In the midst of a harsh and long debate, the ruling party had committed in the voice of the coordinator of Morena, Adán Augusto López, not to bring these reforms to the plenary session until next week, but reported that the PVEM presented a request to include in the agenda for today’s session.
The opposition celebrated that the ruling party reversed the changes to article 1 of the Magna Carta, because “it is a step in the right direction,” he said.
The reform establishes that the amparo trial against additions or reforms to the Political Constitution will not proceed.
With the modifications, the opinion states, the aim is to clarify, “for those who today consider that a reform is contestable,” that the current Mexican constitutional system does not contemplate this possibility.
The document highlights that the initial initiative was modified, which is why the reform that the proponents had proposed to modify article 1 of the Political Constitution was omitted from the opinion, and which stated that:
“The norms relating to human rights will be interpreted in accordance with this Constitution and with the international treaties on the matter, favoring people at all times with the broadest protection, but in no case may they be disapplied by means of conventionality control.” .
They ask to stop the initiative
Civil society organizations are preparing a letter addressed to the Chamber of Deputies and the Senate of the Republic, where they will ask that alternatives be considered that may allow strengthening constitutional stability and the effective protection of human rights.
This, after Morena, through its coordinators in San Lázaro and the Chamber of Senators, Ricardo Monreal and Adán Augusto López, seek to establish that no power can override the determinations of the constituent or the Supreme Court of Justice of the Nation.
The organizations pointed out that there are alternatives to guarantee governability and constitutional stability without sacrificing the rights of all people.
