The Paris Court of Appeal on Thursday ordered the blocking of several non-European pornographic sites due to the lack of control of the age of users, but granted a reprieve to platforms hosted in the EU.
Seized by child protection associations, the court thus demanded the blocking of certain sites “until the implementation by the latter of a control other than purely declarative of the fact that the users are of legal age is demonstrated”she said in a press release.
For other sites, hosted in the EU and which have raised a question relating to European law, French justice will await a response from the Court of Justice of the European Union (CJEU) to render its decision.
Frédéric Benoist, association lawyer “The Voice of the Child” et “e-Childhood”declared to AFP ” disappointed “ by the decision. “Major sites escape a blockage that should be imposed”he regretted.
After the adoption in May of the law aimed at securing the internet (Sren), the audiovisual regulatory authority (Arcom) published at the beginning of October a framework to regulate the “reliability of user age control” on pornographic sites while respecting their privacy, imposing at least one security device “double anonymity”.
According to Arcom, 2.3 million minors visit pornographic sites every month.
