A federal judge in Querétaro granted a provisional suspension and ordered the 32 local congresses to refrain from harmonizing the reform of the Judicial Branch to the local constitutions for irregularities during the legislative process.
The suspension derived from an injunction promoted by the Citizen Movement deputy, Laura Ballesteros, who denounced various irregularities in the approval of the constitutional reform, as if it was held in an alternate venue without conditions to guarantee the voting of legislators.
“The provisional suspension is granted so that the effects and consequences of the aforementioned decree are prevented, that is, so that the responsible authorities refrain from attending to the eighth transitory of the Decree by which various dissipations of the Constitution are reformed, added and repealed… “refrain from making adjustments to the constitutions to adjust the judicial reform during the period of one hundred and eighty calendar days from the entry into force.”says the document.
The legislator pointed out that “Citizen Movement presented elements of evidence through which Morena’s irregularities are listed, by trying to impose his steamroller without listening to his sympathizers, and made illegal votes in the Chamber of Deputies and the Senate.”
The appeal presented also mentions obstacles against legislators to enter the place where the session was held (Arms Room), the lack of verification of quorum and the lack of verification of deputies of the members in the Chamber of Deputies in the place.
In the case of the Senate, evidence was presented related to the illegal deprivation of Emecista senator Daniel Barreda; “while one more was doused with gasoline and others were extorted,” he said.
“Clearly there were no conditions to meet: It was not even guaranteed that senators would vote freely. Despite that, they imposed the vote. In addition to the irregularities in the process, the Judicial Reform destroys, de facto, the division of powers, by allowing the Judicial Branch to be captured by Morena,” explained Laura Ballesteros.
