The Judiciary reported that the location and arrest warrants against the fugitive former supreme judge from justice César Hinostroza are in force. The Supreme Court of Investigation made this clarification on the night of Saturday, September 9.

As is public knowledge, the former magistrate is wanted by the authorities for the alleged commission of the crimes of criminal organization, legal sponsorship and incompatible negotiation. This measure has been in force since April 2023, the month in which this situation was reported to the Peruvian National Police (PNP).
The court also reported that César Hinostroza must still complete the 36 months of preventive detention ordered against him.

This statement was necessary after the anti-corruption attorney Javier Pacheco asked the Judiciary to correct the reason for which the arrest warrant was requested for the ex-authority involved in the ‘Los Cuellos Blancos’ case.

The legal representative of the State reported that in the Interpol system César Hinostroza was listed as politically persecuted, but not as accused of the aforementioned crimes.
To prevent the authorities from looking for him, the legal defense of the former supreme judge filed a legal appeal with which he sought to deactivate the international red alert imposed against him for nine months.
His appeal was accepted, but according to the deputy public prosecutor specialized in corruption crimes, the nine months already expired on August 18, 2022. It should be noted that since May 2023 the former judge could already be urgently sought.

Given this scenario, the Anti-Corruption Prosecutor’s Office asked Interpol Peru to reactivate the red alert to locate César Hinostroza.

He explained that he wanted the red alert to be deactivated in his search because he is a victim of political persecution. After obtaining a favorable response, he was able to move without any problem in the Schengen area.
The Anti-Corruption Prosecutor’s Office managed to get the extradition requests approved against the former supreme judge, in the framework of the ‘Los Cuellos Blancos’ cases and the alleged delivery of a bribe to a worker of the National Superintendency of Migrations, in exchange for her help to escape from Peru across the border with Ecuador.
Another ‘move’ in his favor has been to take advantage of the ‘Soto Law’ or Law 31751, which allows him to request the prescription of criminal action specifically in the case where he is accused of allegedly committing the crime of illegal sponsorship.
Thus, Hinostroza wants the evidence collected by the Public Ministry on the coordination he made with Walter Ríos, former president of the Superior Court of Callao, to be annulled.
“This law is applied retroactively because the principle of combination of norms governs: when there is a conflict in norms over time, the most favorable one must be applied and this is a substantive criminal law. It does not admit any discussion that should have been applied at the time and they have not done so. It is time for it to be corrected, ”explained his lawyer, Joel Macera.
Although he is a fugitive, César Hinostroza continues to receive a pension for having held a high position in the Judiciary.
In this sense, he receives about S/7,870 each month, since he has been considered a retired pensioner since 2021, according to the weekly Hildebrandt en sus Trece.
