This morning, the National Penitentiary Institute (INPE) designated the penitentiary establishment where Betssy Chavez will serve the 18 months of pretrial detention issued against her. The authorities have chosen to transfer the former prime minister to the Anexo Mujeres Chorrillos prison.

The ex-premier’s legal defense had requested that the defendant be confined in a Tacna prison, as she argued before the Judiciary (PJ) that she has no family in Metropolitan Lima. However, the petition was not approved.

Chavez Chino will spend the next few months in the same establishment that once housed former presidential candidate Keiko Fujimori, former first lady Nadine Heredia and Pedro Castillo’s sister-in-law, Yenifer Paredes.

“INPE reports that the defendant, Betssy Chávez Chino, has been classified to the Chorrillos Women’s Annex Penitentiary Establishment, in accordance with the procedures established by the INPE”, the entity communicated through its Twitter account.

The lawyer for the former head of the Presidency of the Council of Ministers (PCM), Erwin Siccha, announced that he will present a habeas corpus appeal to the Constitutional Court (TC) to annul the 18 months of preventive detention. However, the president of this entity, magistrate Francisco Morales Saravia, assured that before resorting to this measure, other processes must be taken into account.

“Everyone who is being prosecuted in a criminal process has their own resources in that process. Then he has to exhaust a series of conditions to be able to resort to habeas corpus. This will have a long way to go because as long as the criminal issue is not defined, constitutional justice is not competent, ”he explained to Canal N.

The official indicated that the Supreme Court determined that there are possibilities of presenting a habeas corpus within the same instance and only after that could the request be transferred to the TC. However, Chavez Chino’s lawyer assured that they have exhausted the appeals and will go directly to constitutional justice.

“(We are not going to file) an appeal because the appeals in the ordinary criminal court have already been exhausted, but we will do so before the constitutional courts. We will bring all the actions in order to reverse this decision that we consider, I reiterate, arbitrary,” the lawyer explained to RPP Noticias.

“She is the only one investigated to whom a tax provision has been declared secret and secret investigation acts have been carried out to try to force, try to prove the budgets in second instance so that a preventive detention is imposed on her,” he added.

The former parliamentarian of Peru Libre is also facing a tax investigation for allegedly having participated in the self-coup perpetrated by former President Pedro Castillo on December 7, 2022. The Public Ministry accuses Betssy Chavez of the alleged crimes of conspiracy and rebellion in the condition by co-author.
