Registered in the European Union directive of October 25, 2012,“restorative justice” was introduced in France by the law of August 15, 2014 and its implementation has been effective since 2017.
Long experienced in Canada, Great Britain, Australia or the United States, it consists in bringing together victims and perpetrators of offenses (whether they are parties involved in the same case or not). Complementary to criminal sanctions, it aims to restore social ties and better prevent recidivism.
To take place, these meetings require the recognition of the facts by the condemned person, the information of the participants and their consent, the mandatory presence of an independent and trained third party, control by the judicial authority and the confidentiality of the exchanges.
