On Thursday afternoon, legislators from the Mexico City Congress found themselves in the middle of a discussion after deputies from the National Regeneration Movement (Morena), accidentally implicated one of its members in alleged acts of corruption.

Since the Morenista deputy Marcela Fuentes presented a point of agreement in which she pointed out Lía Limón, mayoress of Álvaro Obregón for alleged irregularities in a public works contract carried out in May 2021, according to a review by the Superior Audit of the Federation (ASF).
This would be with the company ABC Estudios SA de CV for the amount of 12 million 840 thousand pesos in order to rehabilitate a Civil Protection building within the Álvaro Obregón mayor’s office.

But the invitation for the direct adjudication of the work did not contain the established requirements since a Declaration of Environmental Compliance or study of Ecological Damage was not presented, among other indications mentioned by the deputy.
However, the legislators who were members of the opposition noticed something peculiar, because in those years, in reality, the person who was in charge of the mayor’s office was the now governor of the state of Campeche, for the guinda party, Layda Sansores.

This review is found in file ASCM-178-21, which indicates that the audit was carried out at the General Directorate of Works and Urban Development (DGODU) of the Álvaro Obregón mayor’s office for the contract Rehabilitation of public buildings, within the perimeter of the mayor’s office (civil protection building).
According to the file, the ASF found that the Declaration of Environmental Compliance with folio 005252, was processed after the deadline: 181 calendar days after the start date of the works and the Environmental Damage Study was not submitted.
Since the start date of the contract work was May 24, 2021 and the declaration was received by the Ministry of the Environment (SEDEMA) until November 21, 2021.
When confronted by the federal authorities to explain the reason, the DGODU indicated that the company could not present the Declaration earlier due to the restrictions due to the COVID-19 pandemic.
Given this, the auditing body pointed out that the mayor’s office should establish supervision and control mechanisms so that this type of act does not happen again.

In this section, after reviewing the documentation in the file, the ASF determined that the invitation for the contracting procedure did not meet the requirements established in the Administrative Policies, Bases and Guidelines on Public Works.

The mayor’s office claimed that the catalog of concepts, location sketches, as well as the terms of reference that were delivered to the contractor company in the invitation despite the fact that they were not included in the file.

This section indicates that the DGODU omitted to verify that the detailed execution programs, supplies of materials and equipment for permanent installation, use of labor, machinery and construction equipment for the works had the authorization of the supervisory residence.
This is contemplated in article 50 of the Public Works Law of the Federal District, where it is stipulated that the supervisory residence will be in charge of the indicated matters and will be established by the delegations before the date of initiation of the work.
According to the ASF’s analysis, the documentation presented did not have the signature of this figure.

Within the section on the Execution of Public Works, they determined that the mayor’s office did not register the representatives of the agency who formalized the contract, their addresses and telephone numbers, nor those who delivered the work once the work was completed and who protected it. .
Although they corrected the supposed omission of the work residence registration, the supervision of program updates, the authorization, follow-up and payment of extraordinary concepts and excess volumes, conditions that originate variations in the program and amounts were lacking.
Among other things, he also highlighted that three withholdings were not made due to late works; 41 concepts of work that exceed the amount contracted without having the document that authorizes the execution or that determines the obligation to make a payment, as well as the lack of documentation that has the signature of the work resident that authorizes and validates extraordinary prices (of 25 additional work concepts).
