The Executive Commission for Attention to Victims of Mexico City (CEAVI) reported that the biological father of the young women who died when they fell into a strainer without a lid when they were on their way to a concert at the Palacio de los Deportes, enjoys full rights to be part of the reparation agreement for being considered an indirect victim, despite the statements of the mother of the victims who assured that she abandoned them 15 years ago.
What happened to the case of the young women who died from falling into a drain?
The 23 and 16-year-old sisters were going to the concert of the Zoé group that was presented at the Palacio de los Deportes, east of Mexico City.
“The (biological) father and his lawyer appeared at the Iztacalco Public Ministry, who recognized his status as an indirect victim by proving his filial relationship, exhibiting evidence of recent bank transfers and photographs that also show recent coexistence. Therefore, he enjoys full rights as a father, regardless of his condition of legal separation from his former partner, ”CEAVI responded to Infobae Mexico.
On February 15, 2023, the spokesman for the Mexico City Attorney General’s Office (FGJCDMX), Ulises Lara, reported on a reparation agreement with the biological father of the victims: “derived from the channeling carried out by the Ministry In order to exhaust the Alternate Dispute Resolution Mechanism, requested by the father of the direct victims, a session was held with legal representatives of the Mexico City Water System, in which a reparation agreement for immediate compliance was signed. , with which the aggrieved party was satisfied, for which its compliance was approved.”

The FGJCDMX asked CEAVI to recognize the deceased as direct victims, as well as their nuclear family -biological mother and father- as indirect victims, and the consequent entry of said persons into the National Registry of Victims. However, María Elvira Canchola, mother of Sofía and Esmeralda, accused that this reparation agreement was carried out with the father of her daughters who abandoned them more than 15 years ago and who, she assured, has a complaint for breach of alimony.

In an interview with Infobae México, Teófilo Benítez, Mrs. Canchola’s lawyer, assured that no authority from Mexico City contacted his client to reach a reparation agreement, much less to add her as a direct victim, as reported by the Prosecutor’s Office
He pointed out that his client sees that the reparation agreement between the father and the authorities was made in a “painful and pitiful” way for his client, because she has insisted on finding those responsible for the death of her daughters since last year. She pointed out that the Victims Commission has not wanted to recognize her as an indirect victim, while her father, who lives in Guanajuato, was recognized immediately.
Infobae México sought CEAVI before the public statements of the mother of the 23 and 16-year-old girls, denying that they had not held meetings with Mrs. Canchola.
“Since the first moments after the unfortunate event, in the company of the DIF, the area of attention to Victims of the Prosecutor’s Office and the Office of the Attorney for the Defense of Minors, CEAVI personnel have met at least 8 times with Mrs. María Elvira Canchola: at the funeral services, at his home and at the CEAVI headquarters,” said the capital agency.
The Executive Commission explained that the legal processes continue their course despite the public expressions of Mrs. Canchola and clarified that, with Mrs. María Elvira Canchola, the communication “was interrupted and hindered by the criteria of the firm that legally represents her, despite multiple attempts to resume meetings. As soon as the will of the office and/or the mother is favourable, the endowment of supports pending to be delivered to the affected family nucleus will be resumed.
On Thursday, November 10, 2022, while they were walking along the sidewalk of Viaducto Río Piedad avenue, in the Iztacalco mayor’s office, east of CDMX, and due to the lack of public lighting, one of the sisters fell into the drain that had a height of approximately 3 meters, hitting her head and getting trapped. When trying to rescue her, her sister entered the sewer, but the lack of oxygen and methane gas killed the young women. According to the first versions, a person, who was presumably her stepfather, tried to rescue them without success.
