According to the precautionary measure, this decision was taken to protect, in case it was determined, the innocence of the minister of the Supreme Court of Justice of the Nation (SCJN). The petition was requested by Yasmín Esquivel herself in order to stop the “media controversy” that has been generated around her case.

The suspension measure was issued by the minister on the same day—February 13—that the University presented evidence that contributes to the case of plagiarism of the defendant’s thesis; however, the rector of the UNAM, Enrique Grau, pointed out that it is still in the process of analysis.

“State bodies have the obligation not to informally condemn a person to issue judgment before society, until their responsibility is proven, because when doing so, even without mentioning the name, but giving precise information that allows us to know which person it is treated, results in the violation of rights.”
