Police arrests: How should the PNP intervene in women, Afro-Peruvians and the LGBTI community?

State entities refrain from carrying out actions based on racial or ethnic-cultural characteristics of Afro-Peruvians, such as their appearance, their skin color or their physical features.

The Ministry for Women (MIMP) approved this Wednesday the joint action protocol of the State for the procedure of arrest, detention and police intervention in groups in conditions of vulnerability.

It is a document that contains the General and Specific Provisions that the PNP must follow in contexts that involve children and adolescents; older adults; women; People with disabilities; people belonging to indigenous and Amazonian peoples; Afro-Peruvian people; LGTBI people; and migrants seeking refuge, refugees, political asylees and asylum seekers.

This note details indications for three of them at a time when the institution is denounced for repression and arbitrary arrests due to anti-government protests.

♦ In an intervention, detention and/or police action of a woman in flagrante delicto, the PNP informs the Ministry of Justice to provide the criminal public defense service, in case it does not have a private defense, and with the MIMP through the Women’s Emergency Centers, within the framework of their powers.

♦ Within the framework of police interventions that lead to arrests or arrests involving persons indicated in the previous paragraph, the MIMP through the Aurora National Program, and within the framework of its powers, provides its corresponding complementary services (legal advice, psychological care and social assistance).
