The sentence for the appalling crime of Lucio Dupuy will be read in a few hours in courtroom No. 8 of the Santa Rosa courts. It will be the end of a long legal path for the family of the 5-year-old boy, but also a corollary to a history of torture, mistreatment and violence that began in August 2020 and lasted until November 26, 2021, when the little boy He was murdered by, according to suspicions of justice, his mother and her girlfriend.

The investigators verified that there were 15 months of harassment, beatings and rapes. Infobae managed to access, based on the file, a complete reconstruction of one of the most aberrational crimes in Argentine criminal history.

To walk the path of Lucio, since he went to live with his mother, is to enter a story of silenced pain, of a solitary sorrow that the baby shouted as best he could and that no one heard.

July 31, 2020 can be marked as the moment Lucio’s ordeal began. That day, the boy got on a bus with her mother, Magdalena Espósito, and her girlfriend, Abigaíl Páez. They traveled from General Pico, where Lucio lived with his paternal uncles, to Santa Rosa where his mother planned to raise him. The reality indicates that this trip should only last one weekend, but due to the quarantine due to the pandemic, the little boy could not return to Pico with his uncles.

A few weeks later, Lucio’s paternal uncles decided to sign the custody in favor of the mother. Why? It has a more than logical explanation. Since 2019 the baby lived with them by court decision and every time Magdalena visited Lucio at the uncle’s house, a police scandal was generated. It’s that the parent made false complaints permanently, went to see him with the police, screams and discussions were heard. The situation had long since become untenable. And in the middle, as always, the same victim: Lucio. The little boy lived stressful situations with his mother’s visits.

For all this, on August 20 the uncles signed the agreement and on November 4 Judge Ana Clara Pérez Ballester approved that document. That day, officially, Lucio’s possession was in the hands of his mother.

The baby’s ordeal was in progress, already made official and approved by the courts.

A few days after starting to live with his mother and her girlfriend, Lucio began a long pilgrimage to different hospitals and health clinics in Santa Rosa. On December 15, 2020, the little boy was treated at the Evita Hospital in Santa Rosa for trauma to the upper limb. Three days later, on December 18, he was again treated at the Molas Hospital for a fractured wrist and hand.

On January 22, 2021, Lucio was treated at a health post in the Río Atuel neighborhood, again due to trauma to one of his arms. On February 1, he was again admitted to the Evita Hospital in Santa Rosa due to injuries to his body. Less than two months after that attention, on March 23, he entered Evita again, this time due to a deformity in a finger as a result of a bone fracture. In the latter case, someone had pulled his finger back until it broke.

Apparently no one found it strange that a child was admitted so many times to different hospitals due to injuries to his arms, hands and his entire body. Obviously, no doctor thought it right to go into Lucio’s medical history and raise an alarm. They could have saved his life.

For almost all of 2021, Lucio suffered all kinds of torture. This was proven in the file with many tests, but three of which are extremely clear: the autopsy, the chats between them and the testimonies of the neighbors.

The examination of the minor’s body revealed that Lucio had recent and old injuries. Some of those injuries were scars from several months prior to his death. The baby had injuries to his hip, legs and one of his buttocks. In addition, he had bite wounds on his genitals.

That report also noted that, during the 15 months that Lucio lived with his mother and his girlfriend, he was sexually abused. He had injuries to his body consistent with rape. This data, combined with the results of the raid on the house of the defendants, add more horror to the situation. In the mother’s nightstand drawer, a sex toy was found. When that element was analyzed in the laboratory, it was discovered that it had Lucio’s DNA.

On August 25, 2021, a month before Lucio’s murder, an event occurred that could have saved his life, but that did not happen because the negligence of some public officials, more precisely, police officers, became present.

A neighbor heard how Lucio was beaten and decided to act. She wanted to call 911, but the microphone on her cell phone was broken. Therefore, he asked his brother to make the call. He explained it to her in the following way via chat: “Will you call the police? That I have a broken speaker. Because they are hitting the boy next door,” wrote the neighbor. On the other side, her brother replied that the police were already on their way. The woman followed the talk and added: “Every day he comes in from the garden and his mother’s girlfriend shits him with a stick. She hit the wall because everything is heard from my room and on the street too ”.

While the woman’s brother repeated that the police were on their way, the neighbor wrote another extremely forceful message: “I listen to how one of them says to the other ‘Take off his clothes and beat him up, leave it marked because I’ll kill him.”

But the most incredible thing of all is that the police never arrived at the place.

La Pampa police chief Daniel Guinchinau, who is still in office, clarified a few days after Lucio’s murder that the police did not go to the scene because they had the wrong address.

The error was expressed in an official document of the pampean force. “Male requests police mobile at the request of the sister who is in apartment 2,” says the first internal communication at 6:21 p.m. on that August 25.

In the second contact between the police, at 6:45 p.m., the address is already different from the one that had been requested. The officers report that they went to a place where children do not live: “Report that at calle xxxx 2386 (the original is 2385), apartment 1 (the real one is apartment 2) a woman residing in the place was interviewed, asked about the existence of children In the complex, she herself stated that there were no children in the place,” the text says.

The policemen withdrew. No one bothered to call the complainant again to clarify the address. No one had the slightest concern for a baby who was in danger. That boy was Lucio and he was assassinated two months later.

Although it may seem incredible, Lucio’s mother and his girlfriend were the ones who built the strongest evidence against him. They did it in the conversations they had through WhatsApp. An investigator confessed to Infobae: “When we opened the phones, we couldn’t believe how they were reporting the beatings they owed to Lucio.”

The messages are horrifying but they allow us to see first-hand the suffering to which Lucio was exposed in those months of terror.

One of the chats that attracted the most attention is the one that, in October 2021, days before the murder, Lucio’s mother sent to her partner. The conversation began with sayings about the boy, who was misbehaving, and Abigail confessed that she hit him. Faced with this situation, far from worrying about the health of her son, Esposito Valenti replied: “Don’t get out of hand, we’re going to send a shit up.”

It was not the only message. In the file, there are dozens. One more aberrational than the other.

“I’m fed up. I have to be with this asshole all day, ”Abigaíl Páez wrote to his girlfriend. Lucio’s mother tried to calm her down and sympathized with the situation. She never showed the slightest concern for her son.

There is more. In another conversation, Magdalena asked Abigail: “How did you hit him? It’s already been two times that she vomits ”. There is another talk in which they said that the baby was left in the courtyard as a penance, one rainy day. The mother’s girlfriend wrote: “I don’t even want to see Lucio because he makes my life bitter.”

All this evidence allowed justice to put together the puzzle of what Lucio experienced before he was assassinated on November 26. But there were other elements that gave justice the pattern of how it was, chronologically, on the day of the murder.

That Friday, as the investigators suspect and proved during the oral debate, Lucio was beaten when he returned from the garden at 5:30 p.m. There were two hours of constant blows. That determined the autopsy. The beating only stopped two hours later, when the two women left on a motorcycle at 7:40 p.m. and left the baby alone. Probably already dead or at least dying.

At 8:40 p.m., only Abigail returned, because Magdalena had stayed at her night job. In her statement to the court, her mother’s girlfriend said that she grabbed Lucio’s arm because “he was giving a shit” and “kicked him in the tail” and then he vanished. The reality points to something quite different.

Lucio had a wound on his back from the day of the murder. A stomp so powerful that the sole of the shoe was imprinted on him. Exactly the same thing that happened with Fernando Báez Sosa. That aggression, specialists believe, burst his heart. The scopometric expertise indicated that the sole that was marked on Lucio’s little back belonged to the shoe that Abigaíl Páez was wearing that night.

At 9:25 p.m., Páez left with Lucio in his arms for the hospital. It was late, the little boy had died. He did not resist that last attack. When the woman arrived at the hospital, she said that they had been victims of a robbery. Then her mother arrived and supported the same version. They did not believe them. They lied. The doctors made the complaint and both were detained.

Once the two were apprehended, they had to be taken out of La Pampa. It is that when the news began to travel through the media, the indignation of the people was so great that they tried to lynch them. For this reason, the court decided to house them in the province of San Luis, in the Penitentiary Complex No. 1.

There they remain to this day. They are together, in the same pavilion, where they are accompanied by other inmates who also killed their children.

In just a few minutes, they will be transferred to a specially equipped room where the two will connect to a Zoom to hear the sentence against them. Both preferred to follow the verdict from a distance. They did not dare to be present.

The sentence will be known at noon today. It will be at 12. At that moment it will be known if they are guilty or innocent and, in any case, for what crime. An entire country will be watching that moment. Many will pray for justice to be done for Lucio Abel Dupuy.
