The head of the First District Court in Yucatan, Adrian Fernando Novelo Perezgranted the civil association Defending the Right to a Healthy Environment a second definitive suspension against the work on Section 5 South of the Mayan Train.
Incident resolved on July 29 by Judge Adrián Novelo was published today on electronic platforms. corresponds to the application for protection 923/ 2022promoted in April and refers to the permits, authorizations and work of planning, execution and development of activities of the section that goes from Cancun to Tulum.
It will be this August 5 when the hearing will be held in which the merits of the case will be resolved, to determine if the protection is granted to the civil association.
Antonella Vázquez, founder of the organization, explained that the judge decided to grant the definitive suspension by confirming that there is no environmental impact authorization for Section 5 Northfrom Cancun to Playa del Carmen.
Nor have the conditions of the environmental impact authorization issued by the Ministry of the Environment and Natural Resources (Semarnat) been met on June 20, regarding Section 5 South, from Playa del Carmen to Tulum, he explained.
The lawyer pointed out that on the latter they presented an extension that combats the issuance of that authorization, since it should not have been issued, given that the works in Section 5 South began before having permitswhich constitutes a violation of the precautionary principle and the Environmental Impact Assessment Procedure (PEIA).
In addition, the General Law of Ecological Balance and Environmental Protection establishes that the foregoing is a reason to deny the authorization of environmental impact to a work, project or activity.
On the other hand, in the same resolution of today’s incident, the judge denied the civil organization the definitive suspension, with respect to other acts claimed in addition to those that gave rise to the application for protection 923/ 2022.
