President Andrés Manuel López Obrador decreed this Monday the expropriation of 36 private properties with an extension of more than 109 hectares for the construction of Section 5 of the Mayan Trainlocated in the municipalities of Solidaridad, Benito Juárez, Puerto Morelos and Tulum, Quintana Roo.
In the decree published in the evening edition of the Official Gazette of the Federation (DOF), it is detailed that the Secretariat of Agrarian, Territorial and Urban Development (Sedatu) will cover the amount of compensation that in terms of law must be paid to those who prove their legitimate right, in accordance with the appraisals issued by the Institute of Administration and Appraisals of National Assets (Indabin).
The document details that Fonatur and Sedatu will coordinate with the Ministry of Finance and Public Credit (SHCP) to request the expenses that must be covered due to the entry into force of this decree.
“Sedatu proposed to decree the expropriation of the real estate to carry out the construction of the Mayan Train Project, in its section 5, north and south subsections, in the state of Quintana Roo, I have seen fit to issue the following DECREE. ‘FIRST. A total area of 1,093,118.93 m2 (one million ninety-three thousand one hundred eighteen point ninety-three square meters) is expropriated for public use in favor of the Federation for the execution of section 5, north and south subsections of the Mayan Train Project, corresponding to thirty-six privately owned properties'”, reads the document.
The decree states that those interested in this decree must be personally notified. “In the event that their domicile is unknown, a second publication must be made in the DOF so that it has the effects of personal notification. Within ten working days following the notification of this decree, the interested parties may go to the judicial procedure to be refers to article 11 of the Expropriation Law, with the sole purpose of contesting the amount of compensation”.
It is detailed that this decree will enter into force tomorrow, Tuesday, August 2. This decree is published after this weekend, President López Obrador supervised, in the company of the Governor of Quintana Roo, Carlos Joaquín González, Section 5 of the Mayan Train that goes from Cancun to Tulum, suspended due to injunctions presented by environmentalists, but declared as a national security work to continue with the work.
Judge gives second definitive suspension to works of Section 5
Also this Monday, the First District Judge residing in Yucatan, Adrián Fernando Novelo Pérez, granted a second definitive suspension against the works of section five of the Mayan Train.
It is a suspension in favor of the civil association Defending the Right to a Healthy Environmentwhose members filed a demand for guarantees on April 5.
The organization requested to stop the work by challenging the permits, authorizationsas well as the planning, execution, and development of activities in section five of the Mayan Train, which runs from Cancun to Tulum North.
After granting the suspension, Judge Novelo Pérez scheduled the constitutional hearing for next August 5, the date on which he will decide whether to grant the definitive protection to the civil association.
