A second chance? On December 23, Petroperú decided to declare the nullity of the Biodiesel B100 acquisition contract with Heaven Petroleum Operators, because it was detected that there was not the presence of a notary public at the time of receipt of the bidders’ proposals. That time, the state company announced that it would make a new call to allow it to cover the demand for this product.
However, this Tuesday, they indicated that “after carrying out an exhaustive and rigorous evaluation of the four proposals of the participating national and international companies, Petróleos del Perú (Petroperú)” again awarded the good pro of the purchase of Biodiesel B100 to the same company: Heaven Petroleum Operators, whose representative Samir Abudayeh attended the Palace to meet with the President of the Republic, Pedro Castillo.
The acquisition by competition COM-013-2021-GDCH / PETROPERÚ, for the purchase of Biodiesel B100 comprises the period between January and April of this year.
THE PROCESS
This second process began on January 5 with the invitation to 69 qualified suppliers, both national and international, with experience in supplying this fuel. Petroperú assured that the process was carried out with total transparency, in accordance with the hydrocarbon acquisition procedure.
This time, they indicated that a notary public was present at the time of receipt of the bidders’ proposals on January 10. The notary public was Rulby Vela, who “attested to the act, so that the process is carried out with the principles of transparency, impartiality and fair and equal treatment among the participating companies.”
The companies that presented their proposal were:
1 Repsol Trading (international companies)
2 Trafigura (international companies)
3 Bio Energy Peru (national companies)
4 Heaven Petroleum Operators SA (national companies)
The state-owned company stated that with the purchase of this product they will guarantee the production and supply of fuels, at the national level, “in accordance with the regulations in force in the country’s hydrocarbon market.”
Finally, they said that Petroperú has been coordinating the simultaneous control of the Office of the Comptroller General of the Republic in the hydrocarbon purchase processes that it executes.
THE CASE OF PETROPERÚ
In December, a report from the Punto Final program showed that, according to the official registry of visits to the Government Palace, on October 18, between 9:21 a.m. and 11:10 a.m., President Pedro Castillo received the businesswoman Karelim López; the manager of Heaven Petroleum Operators, Samir Abudayeh Giha; and the general manager of Petroperú, Hugo Chávez Arévalo,
Two weeks later, Samir Abudayeh Giha’s company won the tender to sell biodiesel to Petroperú, whose manager was also in Palacio, for more than $ 70 million. After that, the suspicion of an alleged direct favoring of Heaven Petroleum Operators raised the alarms. The state-owned company declared the process null and void at the end of December, but again granted the award on Tuesday, January 11.
However, the anti-corruption prosecutor of Lima Norah Córdova opened in December a preliminary investigation of those who attended the meeting with Castillo: Karelim López, Huego Chávez and Samir Abudayeh, for the alleged crimes of collusion and incompatible negotiation.
It is worth mentioning that Pedro Castillo’s lawyer, Eduardo Pachas, assured that the president did not receive Abudayeh, and that the rest of their meetings were separately.
SAMIR ABUDAYEH VERSION
After the questions, the businessman Samir Abudayeh issued a statement in which he denied having committed any irregular act during the first tender that his company won for the purchase of biodiesel from Petroperú. In addition, he claimed to be invited to the Palace to explain to President Castillo the agricultural expansion through the alternative planting of oil palm.
“Never during these years have I had the need to resort to an act outside the law, let alone go to intermediaries who carry out negotiations for us. I have always acted within the law “, he indicated.
