Movimiento Ciudadano (MC) spoke out against the third request for arrest warrants against Mexican scientists by the Attorney General’s Office (FGR). Faced with the search for the agency in charge of Alejandro Gertz Manero for prosecuting the investigators, the orange party asked to “stop the persecution.”
This Wednesday, September 22, through an official statement, the party led by Clemente Castañeda assured that scientists “are not enemies,” but allies of Mexico and that the persecution against them does not contribute to national development.
“The attempt of the Attorney General’s Office to obtain arrest warrants against 31 scientists, researchers and former officials of the National Council of Science and Technology (Conacyt), once again exhibits the factious use that the Federal Government makes of the institutions against critical and uncomfortable voices, as well as their contempt for science and technological innovation ”, reads the MC newsletter.

In this regard, the party has already pointed out that a federal judge denied, “in short,” issuing arrest warrants against the 31 persons named. Reason why, the Citizen Movement demands the federal government to stop.
For this reason, the national coordination of the party reproached the harassment that the scientific community in Mexico is suffering and, unlike the FGR, pointed out that the republic needs to strengthen the development of science and not put obstacles.

And it is that the prosecution of Gertz Manero issued the arrest warrants for the alleged responsibility of these 31 scientists in property crimes against the public purse.

“The arrest warrant will be requested again, clearly explaining what is considered a patrimonial criminal act attributable to said persons, as well as the evidence that proves it,” said the FGR.
However, a judge rejected the FGR’s second request to prosecute those who, in their capacity as public servants, financed a company to which they joined under the approval of an internal statute.
Arguably, it was considered that the private company created, authorized and funded by the group of scientists of the council used federal resources destined for research, with which they bought furniture, vehicles, real estate, paid salaries and direct services. However, this did not update criminal acts because the Consultation Forum indicated in the Conacyt statute endorsed this type of operations.
But for the prosecution this criterion is unacceptable, since an internal statute issued ad-hoc by the Conacyt officials themselves cannot go against the provisions of the Science and Technology Law and the Organic Law of the council itself, which are mandatory for them.

The difference in legal criteria is that the higher regulations do not allow the institution of researchers to become a private company, whose resources are obtained from public funds.
“The Public Ministry of the Federation does not coincide with this criterion and supports the complaints for crimes of a patrimonial nature that are being tried to prosecute, broadly exposing their foundations, motivations and evidence that must necessarily be evaluated in their entirety and made public,” the prosecution formulated of the Republic.
From this perspective, the prosecuting party will continue with its allegations and will exhaust all the processes that are necessary to act in defense of the public interest, so it can be expected that this case will continue to give public opinion something to talk about.
